This agreement is the basis for using Amerivet Enterprises DVBE Certificate General Agreement Between the DVBE. Client and The DVBE Firm: (Amerivet Enterprises Inc)

1. There is no cost to the DVBE Client from this DVBE Firm for any project not awarded to the client.

2. Representatives of the DVBE Firm and the DVBE Client must sign the WRITTEN AGREEMENT BETWEEN BIDDER AND THE DVBE ACTIVITY (Reference: CA DVBE PR (REV. 4-1-2003)

3. Each time the DVBE Client uses this DVBE Firm's certificate with any bid package, the DVBE Client will notify the DVBE Firm immediately, via email or fax.

4. When the DVBE Client is deemed the apparent low bidder, the client will contact the DVBE Firm via phone, fax, email or written letterhead correspondence, to coordinate support relative to the awarded project, and or notify the DVBE of award status.

5. The DVBE Client agrees to purchase supplies or services for the total amount of the DVBE requirement as reflected in bid package of which our support service is reflected and or as may be reflected in the signed agreement.

6. The DVBE Firm agrees to provide supplies, facilitate duties with project officers and or representatives by providing information and or correspondence as may be needed for compliance with the law relative to the D.V.B.E. participation program.

7. Technical support, liaison activities and or executive support outside the general supply support is chargeable at $125.00 an hour, if and when actions are taken by the DVBE Firm.

8. To instill compliance with the intent of this agreement the DVBE Client agrees that any remaining DVBE obligation funds not used in supply or service support will be paid to the DVBE Firm upon project completion, as payment for services rendered.

9. In consideration of the terms of this agreement, the DVBE Client agrees to pay this DVBE firm a retainer of $75.00 for each project awarded to the DVBE Client or a 10% retainer based of the DVBE obligation, for any awarded contracts where the DVBE Firm has been identified as the supporting activity, the greater amount of $75.00 or the 10% will be paid via credit card. Retention payment will be made with in 30 days or upon first order of materials, which ever is sooner.

10. The DVBE Client understands that retainers are non refundable and are independent of other support services. Except, the payment of the retainer will be credited to the DVBE Client toward the total DVBE obligation. These charges allow the DVBE Firm to recover part of the expense for developing and promoting this program that allows any and all contractors to participate on public works projects with out expense, when they do not win a bid for which a DVBE requirement exits.

11. This agreement may be modified from time to time. Users of this process should review the agreement notice every time the certificate is used in support of a bid package.

12. All changes to the agreement that impact less than full DVBE participation must be in writing and signed by both the DVBE Client and the DVBE Firm representatives. Any such agreement should be in the DVBE Client’s possession prior to submitting our DVBE certificate with your bid package.
